Foreigners' Babies Born In The U.S. Are
NOT Constitutionally U.S. Citizens

People ask about ending citizenship for foreigners' babies born here. They ask how it can be done. This is because they believe anyone born here is a citizen.

The constitution states, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." Notice, "and subject to the jurisdiction thereof..."

A baby has to have at least one U.S. citizen parent to be considered under the jurisdiction of the U.S.

Try having our country take any kind of legal action for a baby born here to a couple vacationing from the UK (who's done something bad to the baby), and you'll find out quickly that the U.S. has no jurisdiction over that baby. So, no, babies born here, to two foreign parents are NOT constitutionally U.S. citizens.
